  • By using our website, or our services, you agree to be bound by these terms & conditions.
  • By using our website, or our services, you warrant that you are at least 18 years old or have permission to access this site, or our services.
  • Events outside Contour Aerial's control shall be considered force majeure.
  • Any rates applicable to our services will be those formally agreed between Contour Aerial and you as our client
  • Contour Aerial reserves the right to amend any information without prior notice.

You should understand that by ordering any of our services, you agree to be bound by these terms & conditions.

By placing an order with Contour Aerial, you accept these terms & conditions, which shall apply to all orders placed, or to be placed at Contour Aerial for the performance and supply of any services. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing and signed by us.

Contour Aerial Registrations

Contour Aerial warrants that:

  • Contour Aerial iconducts all operations under a current CASA issued ReOC (RPA Operators Certificate), authorising the conduct of RPAS operations for profit or commercial gain
  • Contour Aerial have met mandatory requirements set by CASA and have a suitable organisational culture and business model for safe Remotely Piloted Aircraft Systems (RPAS) Operations
  • Each person operating an RPAS (drone) on behalf of Contour Aerial is the holder of a current CASA issued RePL (Remote Pilots License)
  • Each person operating an RPAS (drone) on behalf of Contour Aerial is the holder of a current CASA issued AROC (Aeronautical Radio Operator Certificate)

Your Information

  • Any personal information you provide will be used to ensure delivery of website and other services to you.
  • The information you provide is only available to Contour Aerial and will not be shared with other third parties.
  • You always have the right to request Contour Aerial to delete or correct the information held about you.

By accepting the Contour Aerial Conditions, you agree to the above.

Contour Aerial maintains a newsletter and other social media content. Information relating to your project may be referenced on our site, but only with your prior permission.

Intellectual Property Rights

All images, video and data generated on your behalf by Contour Aerial, will remain the property of Contour Aerial, until such time as payment for the service provided to you has been completed.

At that point, ownership of the property will transfer to you, although Contour Aerial will have rights to reproduce these for our marketing and publicity purposes at no cost to Contour Aerial, and subject to you granting permission for such use by Contour Aerial

Taxes

Contour Aerial is registered for GST. All quotes and invoice will include GST. If your organisation is eligible for an exemption please let us know prior to invoicing.

Payment

All products and services provided by Contour Aerial will remain Contour Aerial's property until full payment is made. Payment terms for services is typically 14 day unless prior arrangements have been approved. The price applicable is that set at the date on which you place your order. Incidental costs and payment fees are recognised before confirming the purchase.

Returns Policy

Our  services and data output, being of a digital nature, make it difficult to provide a Returns Policy after delivery of the service / data to you.

If for any reason you are not completely satisfied with the service provided by Contour prior to payment, or completion of the project / service, we will refund any payments made to date, with the exception of on costs, and any direct costs incurred by Contour Aerial for the creation of the output / service.

Where a refund or return is applicable, any data or other outputs which may have been delivered by, or produced by Contour Aerial, shall be returned to, and remain the property of Contour Aerial. Contour Aerial can rescind this right at their discretion.

Force Majeure

Events outside Contour Aerial's control, which are not reasonably foreseeable, shall be considered force majeure, meaning that Contour Aerial is released from any obligations to fulfill contractual agreements. Example of such events are CASA or government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

Liability for Links

The Contour Aerial website includes links to other external third party websites. We have no influence on the contents of those websites, therefore we cannot guarantee those contents. Only the providers or administrators of those linked websites can.

The linked websites have been checked for possible violations of law, or other inappropriateness, at the time of the establishment of the link. Any Illegal, or inappropriate contents were not detected at that time. Should we become aware of any illegal, or inappropriate links, they will be removed, or ammended as appropriate, once we become aware of them. You can notify us via our 'Contact Us' page.

Reproduction, editing, distribution as well as the use of any kind outside the scope of the copyright law require the written permission of the author or originator. Terminology & Acronyms

Acronyms used in this document include:

  • RPAS - Remotely Piloted Aircraft System.  This term describes the aerial flight equipment used by Contour Aerial, and includes all of the terms:
    • Drone -  Remotely 
    • UAV -  Unmanned Aerial Vehicle
    • UAS - Unmanned Aerial System
    • QuadCopter - a Multirotor helicopter, propelled by 4 rotors, and the most common. A hexacopter has 6 rotors, an octocopter has 8 rotors)
  • CASA - Civil Aviation Safety Authority, the Australian national authority for the regulation of all civil aviation.
  • ReOC - RPA Operators Certificate. This is issued by CASA, and is required by any business which operates RPAS (drones / UAV / UAS), commercially in Australia.
  • RePL - Remote Pilot Licence. This is issued by CASA, and is required by any individual which operates RPAS commercially in Australia. It allows the individual to fly for a certified operator (ie, the holder of a remotely pilot aircraft (RPA) operator's certificate, or ReOC)
  • AROC - Aeronautical Radio Operator Certificate. This is issued by CASA, and is required for those individuals who need to transmit on an operational radio frequency, and communicate ground-to-air whilst undertaking RPAS operations. Having an AROC is especially recommended for those RPAS pilots who will be conducting operations in controlled airspace or near non-towered aerodromes.
